1.  (Transfer / Charge / Sublease)

State Lands are normally alienated subject to certain restrictive conditions such as "No Dealing", "No Transfer" or "No Sublease", in addition to the normal terms and conditions of alienation. 

 

2.  Why The Restrictive Conditions ?

i.    To prevent disposal of land for quick profits 
ii.   To ensure the allottee develops the land in accordance with intention of the alienation 

 

3.  How to Apply for Permission to Deal ?

The applicant, who should normally be the registered proprietor, should submit the application to the respective Divisional Superintendent of Land and Survey Department in which the land is situated.  Normally, the applicant applies through the law firm.

 

4.  What are the Requirements ?

  1. The full description of the land, i.e. lot number, block number and name of Land District 

  2. The particulars of the registered proprietors

  3. The particulars of the would-be transferees if (a company or society) such as Memorandum and Articles of Association and Forms 24 and 49 issued under the Companies Act, 1965 and Registration Certificate and Rules and Constitution respectively

  4. The reason or justification of the proposed transaction. 
     

5.  The Application Should also State

i.     In the case of a transfer - the amount of consideration, if any 
ii.    In the case of a charge - the amount to be secured under that charge 
iii.   In the case of a sublease - the duration of the sublease and rental per month or per year .

 

6.  Powers to Approve Transfer & Charge

i.     Divisional Superintendents  have  been  delegated  the  power  to  approve  applications  to  charge  land  in  their

       respective Divisions in cases where the amount does not exceed RM500,000.00 
ii.    Divisional  Superintendents  are  also  likewise  given the  power to  approve  transfer  between  immediate  family

       members in consideration of natural love and affection and transfer to beneficiaries of an estate of a deceased

       person.
