Introduction
-
The Mining Section is one of the
three sections in the Land Branch. This Section deals with all matters relating to mining and the issuing of mining and quarry licencees.

The Headquarters mainly deals with matters relating to
the approving aspects of mining activities and
the issuing of quarry Licenses.
2. A
Brief HISTORY of Mining Regulations in Sarawak
-
Mining activities in Sarawak during the era of the Rajah was mainly known to be actively involved in Bau
District in Kuching Division.

The first Mining Regulation was enacted in Sarawak and incorporated under the Land Legislation as Order No.
VIII OF 1920.
-
This Order was substituted by Order No. L-2 (Land) 1931. The provision of this Order affecting mining activities
was subsequently repealed by the Mining Ordinance under Order M-5 (Mining) 1932 which came into force on 16.7.1932.

This Order M-5 (mining)1932 was again repealed and substituted by Order No. M-5 (Mining) 1935 and came into
force on 16.1.1936.

This ordinance was followed by the introduction of the Mining Rules under Order M-5 (Mining) Rules, 1935 and
also came into force on 16.1.1936. The Mining Ordinance and Rules underwent a series of amendments
as follows:-
- No. 14 of 1949;
- No. 16 of 1950 - Mining Rules;
- No. S. 10 of 1950 (Mining Rules);
- No. 2 of 1955;
- No. S.63 of 1955 (Mining Rules);
- No. 27 of 1957.
vi. The present Mining Ordinance ( No. 20 of 1958 ) was enacted to consolidate the former provisions of the Mining
Ordinance and Rules. The following amendments have been made to the Principal Ordinance and Rules:-

No. 18 of 1962 (Amendment);
- Mining Rules, 1995 (Substitution) (Swk. L.N. 13 & 14 of 23.2.1995).

- Sarawak Mining Ordinance (Cap. 83) - Mining rules,1995 - Land Code (Cap. 81) iv. Manage and implement the processing of applications and issuing of:
- Prospecting Licences - Mining Leases - Quarry Licences
4.
Computerisation (MPIS)
-
Following the decision of the State Mineral
Resources
Committee, the Government have agreed to develop the Mining Section into a
computerised system.

This
Computerisation Project is called the Mining Production and Information System (MPIS).
5.
The State Mineral Resources Committee
(SMRC)
-
The role of the SMRC is
to scrutinize all applications pertaining to mining as received from
time to time and to ensure that all these applications are in strict
compliance with the requirements of the Mining Rules, 1995.

Having ascertained that
the applications are in order, the SMRC would convene a meeting to
discuss and put up the recommendations to the State Government for
further consideration pf the Minister.
