1. What is a Wharf Licence ?
For the purpose of landing stages or the erection and use as a wharf, permission maybe given by the Minister under Section 38(3)
of the Land Code (Cap. 81). In this circumstances, the application to erect and use a wharf may be submitted in writing to
the Divisional Superintendent Land and Survey Department of the Division where the
land is situated.
The process involves the following action :-

Requirements
- A location plan or map showing the area applied for; - A complete set of Engineering or structural plan prepared by registered engineer; and - An architectural plan if there is any building to be erected or constructed on the proposed wharf.
- JKR - Port Authority - Sarawak River Board - Natural Resources and Environment Board - Local Authority
- Individual - Company - Others - Name of applicant - Address - Telephone
- If company, applicant i s to submit 2 certified
copies each of Memorandum and Articles
of Association of the
Company (Form 9), Form 24 (shareholders and shares) and Form 49 (Director and Secretary) - Other relevant information.

Processing the application

Receipt of the application.

The Superintendent will make reference to the relevant authorities for comment :- - JKR - Marine Department - Port Authority - Sarawak River Board - Natural Resources and Environment Board - Local Authority

Details Particulars on the Application will be submitted to Headquarters
for vetting and further submission to the
Ministry of Planning and Resource Management for consideration of the
Minister.

The decision of the Ministry will be conveyed to the Director who will
inform the Divisional Superintendent.

The Divisional Superintendent will
inform the applicant of the decision:- - Approved - Rejected

On the approved case, the Divisional Superintendent will make offer of terms and conditions of the licence and require
the applicant to pay the relevant fees.

Once the offer is accepted and payment of fees has been made by the applicant, the Divisional Superintendent will
submit the Draft Licence to the Director of Lands and Surveys for signature.

After the signature has been attested, the Director will return the
Draft Licence to the Superintendent for record and
custody and distribution to the licensee and relevant authorities.

What are the fees payable? The fees payable are:-
- Annual License fee - RM50.00 - Preparation of License fee - RM50.00
