1.  Definition of Pre Land Code title

The meaning of "Pre Land Code Titles" is not defined under the Provisions of the Land Code (Cap. 81). Pre Land Code Titles literally refer to those titles issued prior to the enactment of the Land Code (Cap.81). In the context of Section 2 of the Land Code (Cap.81), these types of titles are legally known as the "Previous Register" which means "any register kept under the former Land Ordinance or under any Order of the Rajah affecting land". 
 

2.  Types of Pre Land Code Titles 

     Pre Land Code Titles comprise the following type of titles :        

1:

Pre Settlement Lease;

8:

Squatter License; 

2:

Grant; 

9:

Lease of Land; 

3:

Grant Serial; 

10:

Lease of Crown Land; 

4:

Rubber Garden Registration Certificate (RGRC); 

11:

Occupation Ticket; 

5:

Coconut Garden Registration Certificate (CGRC); 

12:

Jubilee Occupation Ticket; 

6:

Pepper Garden Registration Certificate (PGRC); 

13:

White Occupation Ticket; 

7:

Gambier Garden Registration Certificate (GGRC); 

 

 

 

Sections 40(1) and 112(4) of the Land Code authorize the replacement of Pre Land Code titles.  Pre land Code Titles can also be replaced by a Certified Document of Title under Part V of the Land Code as a result of Settlement Operation. 

Pre Land Code Titles are replaced by Land Code Titles because the former were issued prior to the coming into force of the Land Code (Cap.81) and land may not have been properly surveyed or some of them may not have been surveyed at all; 

In cases where land had been surveyed, the accuracy of the survey in regard to the area are subject to doubt as equipment used then were of low order.  Pre Land Code titles are not indefeasible titles under the Land Code - i.e they are not State Guaranteed Titles. 
 

3.  Objectives of replacing Pre Land Code Titles by Land Code Titles    

i.

To confirm the accuracy of the survey and the location of the land; 

ii. 

To survey the land which have not been surveyed before; 

iii.  

To verify ownership of the land; 

iv.  

Update Restrictions and Special Conditions of Titles in accordance with the provisions of the Land Code (Cap.81); 

v. 

To bring all current titles to land under the common prescribed forms provided under the Land code (Cap.81); 

vi.  

To confer on the titles upon replacement by Land Code Titles, the status of indefeasibility as regards to ownerships, areas and surveys of the land in accordance with Section 132 Land Code (Cap.81) (i.e. State Guarantee Titles).
