|
1. Superintendent of Land and Survey is to initiate a program for the replacement of the Pre Land Code Titles by the Land
Code Titles.
2. When a program has been initiated and agreed to SO is to identify an area in the form of a Block
from the Cadastral plans
where there are lots of Pre Land Code Titles are locates for the exercise and
to take the following actions:

2.1. |
Prepare a working plan;
|
|
|
2.2. |
Identify and list out
all the Pre Land Code Titles within the Block and prepare a list
showing the following particulars of the land:
|
2.2.1.
|
Name(s) of the
Registered Proprietors/co-proprietors and their
addresses;
|
|
2.2.2.
|
Detailed
particulars of the land including encumbrances (if
any);
|
|
|
|
2.3. |
When the list has been prepared to collect the Pre Land Code Titles from the registered
proprietors/co-proprietors of the land for the purpose of replacement either under Section 40(1) or
112(4) of the Land Code;
|
|
|
2.4. |
When the Pre Land Code Titles have been collected, SO is to:
|
2.4.1.
|
Acknowledge receipt of the titles;
|
|
2.4.2.
|
Record the titles and keep them in a folder and store them in the cabinet while waiting
for replacement;
|
|
2.4.3.
|
Prepared a list of all the titles collected;
|
|
3. Issue a Survey Job to SS for the following actions:
|
|
3.1. |
To check and verify whether the survey of the lots comply with the requirements as stipulated
in the Survey Branch Manual. If so, whether there is a need to re-compute the areas and to take
action accordingly; and
|
|
|
3.2. |
If the survey of the lots are not in compliance with the requirements stipulated in the Survey
Branch Manual, to re-survey the lots and verify the boundary pegs to the registered
proprietors/co-proprietors of the land. V/B forms to be obtained and all missing pegs to be replaced.
|
4. Once actions in paragraph 3.1 above have
been taken and the re-survey of the lots mentioned in paragraph 3.2 above
completed, SS to provide the following items to SO for his action to replace the
Pre Land Code Titles:

4.1. |
A copy of the Cadastral Plan showing the new lots;
|
|
|
4.2. |
L&S.3 showing the new lots in the Block System, areas and classification/category of the lots;
|
|
|
4.3. |
Grant or Lease Diagrams, Part I LRF or Part II LRF (which ever is applicable); and
|
|
|
4.4. |
The relevant Survey Job.
|
5. Upon receiving the completed Survey Job, plan and all the relevant documents mentioned in 4.1 to 4.4 above from SS, SO
is to take the following actions:

5.1. |
To check full details on correct names, IC numbers and shares of the registered
proprietors/co-proprietors of the lots.
|
|
|
5.2. |
To check the new areas supplied by SS against the original areas on the Pre Land Code Titles,
and L&S 3. If there is a difference in the area, then the area as stated in the L&S.3 is to be
adopted; and
|
|
|
5.3. |
To request SS for Part IV LRF if there is any land held under State Land;
|
6. Once actions on items 5.1 to 5.3 above have been taken, SO is to minute the Survey Job together
with the relevant L&S. 3
and all relevant documents to Title Section for action to of the Title Section to
replace the Pre Land Code Titles.
7. Upon receiving the above, the Title Section is to take the following actions:

7.1. |
To check the particulars of the Pre Land Code Titles such as the names and Identity Cards
numbers of register proprietors/co-proprietors/item of titles/annual rent/ classification/ category/locality/restrictions and special conditions and
encumbrances. To make amendments and update
the restrictions and special conditions (where necessary) in accordance with the Restrictions and
Special Conditions contain in the Land Administration Circular No.1/1994 and DLS Circular
Memorandum - Ref.146/4-16/33 dated 26.6.1995;

7.2. |
To check whether the outstanding annual rent has been paid and if not to collect the same;
|
|
|
7.3. |
To minute to SLS for authority to prepare and replace the Pre Land Code Titles.
|
8. Upon approval given by SLS to prepare and replace the Pre Land Code Titles by proper Land Code
Titles,
Title Section is to take the following actions:

8.1. |
To prepare the titles, LRF, new rent ledger cards and rent books;
|
|
|
8.2. |
To make endorsements of the cancellation and cross-references on the following records:
|
8.2.1. |
The counterparts and Mortgage and Transfer Register of the Pre Land Code Titles.
|
|
8.2.2. |
The rent ledger cards and rent books of the Pre Land Code Titles;
|
|
|
|
8.3. |
To check the titles LRF rent ledger cards and rent books. If in order to arrange for SLS to sign
the titles and LRF.
|
|
|
8.4. |
Above documents signed by SLS to forward them to the Registrar/Assistant Registrar together
with the survey job and all other relevant documents, rent ledger cards and rent books for
registration;
|
9. Registrar / Assistant Register to register the titles and LRF, File up the LRF and return the titles, rent
ledger cards, rent
books, survey job all other relevant documents to Title Section for actions.
10. Title Section to record the titles in the Title Delivery Record Book. Pass the rent ledger cards and
rent books to Revenue
Section for updating.
11. Revenue Section to update the rent ledger cards and rent books. Return the rent books to Title
Section for action. File up
the rent ledger cards in the cabinet.
12. Title Section to minute the titles, rent books, survey job and all other relevant documents to SO for
delivery of the titles
and rent books and filing up of the other documents.
13. SO to issue notices to registered proprietors/ co-proprietors to take delivery of the titles and rent
books.
14. Registered proprietors / co-proprietors to acknowledge receipt of the titles and rent books by signing
the Title Delivery
Record Book.
15. SO to submit quarterly progress report to HQ.
