State lands are normally alienated subject to certain restrictive conditions such as "No Dealing", "No Transfer" or "No Sublease", in addition to the normal terms and conditions of alienation.
2. Why the restrictive conditions ?
To prevent disposal of land for quick profits
To ensure the allottee develops the land in accordance with intention of the alienation
3. How to apply for permission to deal ?
The applicant, normally being the registered proprietor, should submit his application to the Division Superintendent of Land and Survey Department in the Division where the land is situated. Normally, an applicant applies through a law firm.
4. What are the Requirements ?
The full description of the land, i.e. Lot Number, Block Number and name of Land District
The particulars of the registered proprietor,
The particulars of the would-be transferee, chargee / sublessee. If the intended transferee / chargee / sublessee is a company or society, a Memorandum and Articles of Association, Forms 24 and 49 issued under the Companies Act, 1965, Registration Certificate, Rules and Constitution respectively
The reasons or justification for the proposed transaction.
5. The applicant should also state
In the case of a transfer - the amount of consideration, if any
In the case of a charge - the amount to be secured under that charge
In the case of a sublease - the duration of the sublease and rental per month or per year.
6. Powers to approve transfer & charge
Superintendents have been delegated the power to approve applications to charge land in their Divisions in cases where the amount does not exceed RM500,000.00
Superintendents are also given the power to approve transfer between immediate family members in consideration of natural love and affection and transfer to beneficiaries of an estate of a deceased person.
For cases other than the above, the power to approve an application is vested in the Director.
1). What is an AVTC? It is a process whereby a registered proprietor applies to change the usage of the land from one purpose to another. It is also known as land conversion.
2). How to apply ? A registered proprietor must appoint a qualified consultant who will submit on his/her behalf the proposal to the Superintendent of Land and Survey Department of the Division in which the land is situated for consideration by the government.
3). How much does it cost ?
In the event that approval is given, premium is payable based on the difference between the two (2) market values of the land, that is to say, the current value of the land with the existing use and the remaining term of title and that of the proposed use with extended term of sixty (60) years.
Other payments are premium (if any), annual rent, preparation of title fee and registration fee and preparation of instrument fee.
An application for renewal of land leases is an application by a landowner to renew the term of his land title which has expired while an application for extension of term of title is to extend the term of the existing land title.
2. How to apply ?
The landowner must submit an application in writing to the Superintendent of Land and Survey Department of the Division where the land is located. A photo-copy of the old title, print out of title and a plan showing the land are also to be submitted. To furnish full details on the improvements found on the land such as buildings and cultivation. Application forms are obtainable from the Divisional Office (Land Branch).
